OVERVIEW
Discrimination laws generally protect against disparage treatment in the workplace based on a person's race, color, religion, sex (pregnancy), sex (sexual orientation), national origin, age (40 years of age or older), disability or genetic information.
FEDERAL PROTECTION FROM DISCRIMINATION
There are several Federal employment discrimination laws protecting employees from discrimination in the workplace. The most common are:
Title VII of the Civil Rights Act of 1964 (Title VII), which prohibits employment discrimination based on race, color, religion, sex, or national origin;
the Equal Pay Act of 1963 (EPA), which protects men and women who perform substantially equal work in the same establishment from sex-based wage discrimination;
the Age Discrimination in Employment Act of 1967 (ADEA), which protects individuals who are 40 years of age or older;
Title I and Title V of the Americans with Disabilities Act of 1990, as amended (ADA), which prohibit employment discrimination against qualified individuals with disabilities in the private sector, and in state and local governments;
Sections 501 and 505 of the Rehabilitation Act of 1973, which prohibit discrimination against qualified individuals with disabilities who work in the federal government;
Title II of the Genetic Information Nondiscrimination Act of 2008 (GINA), which prohibits employment discrimination based on genetic information about an applicant, employee, or former employee; and
the Civil Rights Act of 1991, which, among other things, provides monetary damages in cases of intentional employment discrimination.
RIGHTS UNDER FLORIDA LAW
Florida law mirrors the anti-retaliation provisions under the Civil Rights Act of 1964 in protecting employees who oppose illegal discrimination or participate in proceedings under the civil rights laws. The Florida Civil Rights Act outlaws discrimination on the basis of race, color, religion, sex, national origin, age, handicap, or marital status.
DAMAGES
Whenever discrimination is found, the goal of the law is to put the victim of discrimination in the same position (or nearly the same) that he or she would have been if the discrimination had never occurred.
The types of relief will depend upon the discriminatory action and the effect it had on the victim.
The employer also will be required to stop any discriminatory practices and take steps to prevent discrimination in the future.
Punitive damages may be awarded in cases involving intentional discrimination based on a person's race, color, national origin, sex (including pregnancy), religion, disability, or genetic information.
A victim of discrimination also may be able to recover attorney's fees, expert witness fees, and court costs.
